CODE OVERVIEW
Code Description
R101.3 The purpose of the code is to provide MINIMUM requirements
to protect the public and safeguard health.
R102.2 The provisions of the code will not nullify any provisions of
local, state, or federal laws.
R104 The building official (usually hired by the local municipality) is
authorized to enforce the provisions of the code.
R104.2 The building official (typically via the local building department
office) will receive applications, review construction documents
and issue permits for the erection and alteration of building
and structures. He will "enforce" the provisions of the code
by inspecting the projects that have been issued permits.
R104.6 The building official has the right to enter premises where code
violations are suspected to exist at reasonable times upon
request.
R105 Permits are required by any owner or authorized agent who
intends to construct, enlarge, alter, repair, move, demolish or
change the occupancy of a building or structure, or to erect,
install, enlarge, alter, repair, remove, convert or replace any
electrical, gas, mechanical or plumbing system, the installation
of which is regulated by code.
Exempt from Permit (Check with local building official to confirm):
  • Detached (1-story) structures used for storage, recreation, etc. if the floor
    area does not exceed 120 square feet.

  • Fences 6' or lower.

  • Retaining walls that do not measure more than 4' from the bottom of the
    footing to the top of the wall (unless supporting a surcharge)

  • Water tanks supported directly on grade if the capacity does not exceed

  • 5000 gallons and ratio of height to diameter or width does not exceed 2 to 1.
  • Sidewalks and driveways.

  • Finish work such as painting, papering, tiling, carpeting, cabinet installation,
    etc.

  • Prefab swimming pools that are less than 24" deep.

  • Check your neighborhood "Restrictive Covenants" to make sure your project is in compliance with the agreement between you and your neighbors.

  • Check local laws to make sure permitting is not required for any of the exemptions listed.
